Public Consultation on Implementing the AI Act for High-Risk AI Systems

The European Commission has launched a public consultation to gather input on the implementation of the AI Act's provisions for high-risk AI systems. This consultation will inform upcoming Commission guidelines on the classification, obligations, and responsibilities related to these systems.

Introduction

The AI Act represents a landmark regulatory framework designed to ensure that artificial intelligence is used safely and responsibly within the European Union. A central element of the Act is the identification and regulation of “high-risk” AI systems—those that have the potential to significantly impact individuals' health, safety, or fundamental rights.

This public consultation seeks to collect practical insights and real-world examples to support the effective application of the AI Act’s requirements for high-risk AI. It will also address questions around the allocation of responsibilities throughout the AI value chain.

What Constitutes High-Risk AI?

Under the AI Act, high-risk AI systems fall into two categories:

  • AI systems related to product safety, covered under the EU’s harmonised product safety legislation.

  • AI systems used in specific areas, listed in the Act, that may significantly affect people's health, safety, or fundamental rights.

Purpose of the Consultation

The consultation aims to:

  • Gather practical examples to clarify classification of high-risk AI systems

  • Identify implementation challenges and regulatory gaps

  • Explore the allocation of responsibilities among stakeholders in the AI value chain

  • Collect views on compliance obligations and enforcement approaches

Who Should Participate?

This consultation is open to all interested parties, including:

  • Developers and providers of high-risk AI systems

  • Businesses and public authorities deploying such systems

  • Academic and research institutions

  • Civil society organisations

  • Supervisory and regulatory authorities

  • General public and citizens
